Who Should Consider a 1035 Exchange?

Not every policyholder is a candidate. Learn the specific profile — age, policy type, financial situation, and estate goals — that makes a 1035 exchange the right move.

A 1035 exchange is not the right move for every policyholder. It is specifically suited for a narrow but very large demographic: retirement-age individuals who hold whole life policies they no longer need for cash accumulation, but who still want a guaranteed death benefit for their heirs or estate.

The Ideal Candidate Profile

Based on our analysis of thousands of in-force illustrations, the strongest 1035 exchange candidates share most or all of the following characteristics:

Age 55–75

The exchange math works best when the insured is old enough to have significant cash value but young enough to qualify for favorable GUL rates.

$50,000+ Cash Value

The accumulated cash value is the funding mechanism for the new policy. Higher cash value means more death benefit can be guaranteed without future premiums.

Whole Life Policy

Whole life is the most common source policy because of its high premiums, guaranteed cash value, and dividend-dependent returns that often underperform alternatives.

Estate or Legacy Goals

The primary motivation should be preserving a death benefit for heirs, not accumulating more cash value. If you still need the cash, an exchange may not be right.

No Need for Cash Value

If you are no longer relying on the policy's cash value for retirement income or emergency reserves, the cash is better deployed as a premium fund for a GUL.

Insurable Health

Most GUL policies require some level of underwriting. Standard or better health ratings will qualify for the most favorable guaranteed death benefit amounts.

When a 1035 Exchange Is NOT the Right Move

There are situations where keeping the existing whole life policy — or pursuing a different strategy — makes more sense:

You still rely on the policy's cash value as an emergency fund or retirement income source

You are in poor health and cannot qualify for a new policy at favorable rates

Your whole life policy has a large outstanding loan that would reduce the exchangeable cash value significantly

You are under 55 and still in the wealth-accumulation phase of your financial life

Your whole life policy is performing exceptionally well (rare, but possible with certain mutual carriers)
