NAIC Replacement Regulation Notice

A life insurance policy replacement — including a 1035 exchange — is subject to the NAIC Life Insurance and Annuities Replacement Model Regulation (#613) as adopted by your state. Under this regulation, your licensed agent is required to:

  • Provide you with a written comparison of your existing policy and the proposed replacement policy.
  • Leave you with a copy of all sales materials used in the presentation.
  • Notify your existing carrier of the proposed replacement.
  • Provide you with a free-look period (typically 10–30 days) to review the new policy.

These protections are in addition to any rights you have under your existing policy and applicable state law.

Suitability

A 1035 exchange is not suitable for everyone. Factors that may make an exchange unsuitable include, but are not limited to: outstanding policy loans (which may create a taxable event), poor health that would result in higher premiums or uninsurability on a new policy, surrender charges on the existing policy that would significantly reduce the exchanged value, and situations where the existing policy's guaranteed values exceed what is available in the replacement market.
